It should be recalled that the draft legislation originally provided that small farms would be able to operate in built-up areas subject to a decision by the local council, the consent of owners of neighbouring plots within a 200-metre radius, and compliance with sanitary and other requirements. It was also proposed to set limits on the number of animals.
The draft government conclusion notes that a decision by the local council and the consent of neighbours alone are insufficient. The siting of a livestock facility must comply with town planning documentation, the functional purpose of the area, and public health and environmental protection requirements.
It is proposed to review the approach to the maximum number of animals. In the government’s view, this figure must be based on scientific and technical evidence, as the impact of a farm depends not only on the number of animals, but also on their species, husbandry methods, infrastructure, manure and wastewater management, and biosafety standards.
However, the consent of neighbours within a 200-metre radius should not replace mandatory permits, risk assessments and environmental procedures. It can only be considered as an additional factor.
