The provisions on fee-based mediation will come into force on 12 September

In view of the fact that the Law on Mediation and the Status of Mediators will come into force on 12 September 2026, the government has approved three regulatory documents governing their activities. These have been published and will come into force at the same time as the law.

These include the Regulation on the return of a mediator’s licence, certificate and records; the Regulation on the competitive selection of civil society representatives to the Licensing Commission and the Disciplinary Commission for Mediators; and the order approving the licence form.

As previously reported by Logos Press, from 12 September, not only will the fee-based pre-trial mediation procedure become mandatory, but so too will the requirement to obtain a licence to practise such activities. Currently, only a mediator’s certificate is issued following a qualifying examination.

The licence will specify the number and date of the Commission’s decision. Upon cessation of activities or revocation of the licence, it must be returned to the Union of Mediators within 10 days. The document is issued by the Ministry of Justice for an indefinite period, subject to a fee of 450 lei, payable into the Ministry’s account.

It should be noted that the law will apply to civil, family and labour disputes. At the same time, the provisions of the law will not apply to disputes in the tax, customs and administrative spheres, nor to matters of state liability for acts or omissions by public authorities.
