The conditions for inclusion in the List of Service Providers for procurement have been defined

Inclusion in the List of Procurement Service Providers will be optional and will not affect a company’s right to participate in procurement contract award procedures or to carry out ancillary procurement activities.

These rules are set out in the Regulations on the Maintenance of the Register, which will come into force on 1 January 2027. The Regulations establish the procedure for the State Procurement Agency to maintain the register, the procedure for inclusion in and exclusion from it, as well as a transparent and uniform mechanism for the registration of procurement service providers.

Logos Press previously reported on the approval of the relevant regulations, according to which the activities of service providers involve supporting procuring authorities by providing technical infrastructure and advice on the initiation and conduct of public and sectoral procurement.

At the same time, suppliers are required by law to be registered as a legal entity under public or private law and as a personal data controller. The conditions for inclusion on the list will include requirements regarding staff qualifications (including certification), the procedure for forming a working group, and its powers and responsibilities, without prejudice to the obligations incumbent upon the procuring authority. They will also set out the procedure for considering applications for inclusion on the list, maintaining records, suspending a supplier’s eligibility or removing a supplier from the list, and so on.

These provisions do not affect the status, powers and legal regime applicable to central procurement authorities.
