
According to the draft, such reallocation will be carried out on the basis of town planning documentation and with the consent of all owners. The document also establishes the procedure for registering the resulting plots of land.
They will be assigned new cadastral numbers, whilst the numbers of existing plots will remain unchanged.
New powers to regulate cadastral work during redistribution and the preparation of the relevant documentation will be assigned to the Agency for Geodesy, Cartography and Cadastre.
Furthermore, according to the draft, access to cadastral information will be expanded. It will be made available to lawyers and the Ministry of Defence – to verify individuals’ entitlement to service accommodation. In addition, it may be accessed by persons responsible for safeguarding property and executing a will in the event of the owner’s death.
In this regard, the Law on the Real Estate Cadastre will be amended to include provisions setting out the categories of individuals and state bodies authorised to request information about the real estate owned by a person, as well as the conditions under which such information may be obtained.
The draft also includes provisions guaranteeing the rights of individuals during the processing of cadastral data, provided that a balance is maintained between the protection of those rights and the principle of public access.
