Kazakhstan court allows Naftogaz to recover $1.4 bln from Gazprom

A court in Kazakhstan has allowed the Ukrainian state-run energy company Naftohaz to enforce a ruling to recover about $1.4bn from Russia's Gazprom in a gas transit case.

According to Naftohaz, this ruling was the first public decision of a foreign court recognizing and authorizing the enforcement of an arbitration award against Gazprom on the territory of another state. Reuters quoted the Ukrainian company as saying.

“Naftohaz initiated arbitration proceedings against Gazprom in 2022, demanding that the Russian gas giant pay for the organization of natural gas transit through Ukraine.

In March, the Ukrainian company said the Swiss Federal Supreme Court rejected Gazprom’s appeal to overturn an earlier arbitration award that obliges the Russian side to pay Naftogaz more than $1.4 billion plus interest.

“The court decision in Kazakhstan is another practical result in the process of recovering funds from Gazprom,” the press service quoted the company’s CEO Sergey Koretsky as saying. – Naftohaz continues to work on enforcing the arbitration award in various jurisdictions”.
