The procedure is conducted on the basis of Article 103(5) of Law No. 230/2022 on copyright and related rights. It was suspended by AGEPI Notice No. 1069 of 26 June 2026.

The resumption became possible following the completion of a special audit of the activities of the public organisation National Association COPYRIGHT. The audit was initiated by AGEPI Director’s Order No. 82 of 24 June 2026.

The selection of the collecting organisation concerns seven categories of copyright and related rights:

– rights relating to the radio broadcasting of musical works;

– the rights of performers and producers of phonograms to equitable one-off remuneration for the radio broadcasting and public use of commercially published phonograms;

– performers’ rights to equitable remuneration for the radio broadcasting and public use of audiovisual recordings of performances;

– performers’ rights to supplementary annual remuneration;

– the right to compensation for private copying;

– rights relating to cable retransmission;

– rights to the public use of musical works and videograms.

What requirements apply to organisations?

AGEPI has notified accredited collective management organisations dealing with the relevant categories of rights and asked them to submit the necessary documents and supporting information by 9 November inclusive.

When assessing applications, the agency will verify overall compliance with the requirements laid down by law. In particular, organisations must confirm that they have:

– a programme for monitoring the use of works and other protected subject-matter;

– a system for distributing the royalties collected;

– sufficient representativeness of the organisation;

– the necessary human and material resources to collect royalties whilst keeping costs to a minimum.

The appointment of a collecting organisation will be made on the basis of an examination of the documents submitted and a check of compliance with the statutory criteria.

As reported by Logos Press, a dispute arose this summer between AGEPI and the COPYRIGHT association regarding the procedure for selecting a collective collection organisation.

In this regard, AGEPI reiterates that the procedure must be conducted in accordance with the principles of legality, transparency, impartiality and equal treatment of all participating organisations.
