The recalculation of the amounts this year will be made on the basis of the indicator determined by the authority at the level of 15,472.1 lei. The law establishes the mechanism of loss compensation as a permanent mechanism.
Such compensations are established, in accordance with the legislation in force, for people who lost the ability to work due to an accident at work or occupational disease, as well as for those who have the right to compensation in case of loss of breadwinner.
According to the Law “On the Procedure for Recalculating the Amounts of Compensation for Damage Caused to Workers by Injury or Other Health Damage Related to the Performance of Labor Duties”, the initial amount of compensation is a portion of the average monthly earnings that the victim had for the 12 calendar months preceding the industrial accident or professional disease.
It is calculated on the basis of the percentage of loss of professional capacity.
In cases where the victim has been granted a disability pension, the initial amount of damage compensation is reduced by the amount of this pension.
