The contested provision stipulates that a parliamentary resolution proposing the removal of a member of the Supervisory Board or the Executive Committee of the NBM must be forwarded to the president, who must decide on it within 30 days.
The authors of the petition, members of the PSRM parliamentary faction, believe that this procedure raises questions regarding its constitutionality. In their view, the Constitution does not grant the head of state the authority to exercise a “veto” over a parliamentary decision to remove the leadership of an autonomous body such as the NBM.
The deputies cite the principle of the separation and interaction of powers and assert that Parliament cannot, through legislation, expand the president’s constitutional powers.
Thus, the deputies are asking the Constitutional Court to determine whether the new mechanism for dismissing members of the NBM’s leadership complies with the provisions of the Constitution of the Republic of Moldova.
