Currently, the procedure for appointing a single collector has been suspended due to an ongoing audit. The process has also been slowed down by related administrative and judicial proceedings stemming from appeals against the agency’s past decisions, as reported by Logos Press.
AGEPI emphasized that it will resume the procedure immediately upon completion of the audit, urging all parties to strictly adhere to procedural deadlines to avoid further delays.
A key requirement for the organization that will assume the role of the single collector will be the successful completion of an audit of its administrative and technical capabilities. The agency intends to verify the applicant’s ability to ensure a fully transparent mechanism for the collection and distribution of royalties in the interests of all rights holders.
“Appointing a collector is a priority for AGEPI. We are committed to seeing this process through to completion in a transparent, fair, and legally sound manner,” stated AGEPI Acting Director Natalia Mogol.
Legislative Changes
Market participants pointed out a number of practical difficulties in applying the current Law No. 230/2022 on Copyright and Related Rights.
In response, representatives of the Ministry of Justice reported that draft amendments to the law are already being developed. The reform aims to improve the collective management system and further harmonize Moldovan legislation with European Union standards (acquis communautaire). Relevant organizations have been invited to submit their proposals for amending the law.
