The special rules will apply to high-value contracts, excluding VAT: starting at 766,900 lei for the procurement of goods and services and starting at 597,000 lei for construction and repair work. The rules for lower-value procurements are to be established separately by the Government.
The main objective of the new rules is to protect classified information and ensure the security of the military’s supply chain. Contracting authorities will be able to use closed procedures, including restricted tenders and competitive dialogues, and in certain cases—negotiations without publishing a notice—to avoid disclosing military requirements.
Suppliers will be subject to strict requirements: they must guarantee full confidentiality, continuity of supply, availability of spare parts, and the ability to respond quickly in crisis situations.
The law also allows for joint procurement through international organizations, including the European Defense Agency. All appeals and disputes regarding procurement procedures will be examined by the National Agency for the Resolution of Appeals, in compliance with the rules governing the classification of information.
