Periods during which maternity (pregnancy and childbirth) and paternity benefits are received will be officially counted toward the length of service used to calculate pensions. This provision is contained in a bill that was passed by Parliament on its first reading.

The bill also provides for the introduction of the term “employee with family responsibilities” into the Labor Code, which will provide employees with additional protections.

The bill was presented by Mihai-Gabriel Ciobanu, State Secretary of the Ministry of Labor and Social Protection. According to him, an employee with family responsibilities is defined as a person who cares for, supports, assists, or provides financial support to a family member, including a dependent with a disability. The introduction of this concept into national legislation will establish additional legal safeguards in the areas of labor relations and social protection.

In addition, as Logos Press has previously reported, the bill regulates a number of specific safeguards, including those related to night work. For example, single parents with children under the age of 16 may be assigned to night shifts only with their written consent. Until now, this provision applied to employees with children under the age of 4 or children with disabilities.

The bill will be submitted to Parliament for consideration in the second reading. Once adopted, the legislative changes will take effect three months after their publication in the Official Gazette (Monitorul Oficial).

Under current law, maternity leave is at least 126 calendar days and is extended in the event of a complicated delivery or multiple births. Paternity leave is granted for up to 15 calendar days.
