The CNPF fined a non-bank credit institution 250,000 lei

The National Commission for the Financial Market and Financial Services (CNPF) imposed a fine of 250,000 lei on OCN MOGO LOANS SRL, finding that the company had only partially complied with the order issued by CNPF Decision No. 28/3 of June 9, 2025.

According to the CNPF’s decision, the lender is required to revise the loan agreements in which violations of the law were found and to refund consumers all payments made under those agreements, including interest, commissions, fees, penalties, late payment interest, and any other payments, excluding the original loan amount.

In this regard, the CNPF informs consumers who entered into a loan agreement with OCN MOGO LOANS SRL after May 29, 2022, and whose loan remained active as of March 11, 2025, that they may contact the lender to request a review of whether they are entitled to a refund of payments collected in violation of legal provisions. If such a right is confirmed, the lender is obligated to refund the corresponding amounts.

The National Commission specifically clarified that this remedy does not automatically apply to all contracts entered into during the specified period, but only to those in which violations of the law were identified.
