Moldova will create a Guarantee Fund for employees in case of bankruptcy of the enterprise

The guarantee fund initiated by the Ministry of Labor and Social Protection will provide minimum protection of workers' rights in case of bankruptcy or insolvency of the employer.

The Office announced the development of the document and encouraged all interested parties to participate. Proposals can be submitted until May 18, 2026.

The aim is to transpose into national law the provisions of Directive 2008/94/EC on the protection of employees in the event of the bankruptcy of an employer.

The Directive regulates the payment of outstanding debts owed to employees arising out of employment contracts or employment relationships by a guarantee institution, as well as the amount, setting of the payment period, etc.

Earlier Logos Press reported that the National Confederation of Trade Unions of Moldova proposes the creation of a Fund to guarantee the payment of wages to employees in case of bankruptcy or insolvency of an enterprise.

Experts of the organization last year developed and submitted to the Parliament a relevant draft law on the creation, functioning and use of such a Guarantee Fund.

The confederation believes that the adoption of such a project will bring the national legal framework in line with international standards and will contribute to ensuring minimum protection of workers in case of employer’s insolvency.
