The 2019 Hague Convention sets forth the conditions for the recognition and enforcement of judgments in civil and commercial matters and strictly regulates the circumstances under which recognition or enforcement may be refused.
The scope of the convention is limited exclusively to civil and commercial matters. Public law disputes (tax, customs, administrative), as well as arbitration and related proceedings, private international law, and many other matters are entirely excluded from its jurisdiction.
According to the document, Moldova undertakes to enforce judgments of foreign courts falling within the scope of the Convention. In return, judgments of Moldovan courts will have equivalent legal force abroad.
Expected outcome: a reduction in the financial costs of litigation and a significant reduction in the time required to adjudicate and enforce court decisions.
Participants in the Convention include European Union member states, the United Kingdom, Ukraine, Albania, and other countries. The international treaty will enter into force for Moldova one year after the completion of all domestic procedures for ratification and deposit (submission for safekeeping) of the instrument of accession.
