Debt collection procedures are being harmonized with European standards

As part of the process of harmonizing Moldovan legislation with EU legal standards, Moldova has developed new procedures for debt collection and the resolution of cross-border disputes. These procedures will take effect upon Moldova’s accession to the European Union.

The Ministry of Justice has drafted amendments to the legislation. These amendments establish the legal framework for applying, in Moldova, the EU procedures for the collection of uncontested monetary claims and the resolution of cross-border small claims disputes.

To this end, the Civil Procedure Code of the Republic of Moldova will include a definition of and procedure for applying the so-called “European payment order.” It is used in cases where a creditor demands payment of a specific monetary amount and the claim is not disputed.

Upon receiving such an order, the debtor will have the option to pay the debt or file an appeal within one month. In the latter case, the case will proceed within the framework of civil proceedings.

If the debtor does not contest the claim within the specified time limit, the payment order may be enforced. At the same time, creditors will be granted the right to choose from various debt collection methods in accordance with Moldovan law.

The draft also outlines the procedure for resolving cross-border small-claims disputes—up to 5,000 euros. This threshold is established by EU legislation. For certain applications related to the enforcement of judgments, it is proposed to set a state fee of 250 lei.
