Amendments to the Condominium Act came into force

Amendments to the Condominium Act change the rules for the creation and governance of condominium associations and establish new thresholds regarding signatures and voting on resolutions.

An association managing one condominium would require the signatures of 1/4 of the owners, and if it is an owners’ association managing multiple condominiums, the signatures of at least half of them would be required.

Until now, five signatures have been sufficient to establish a condominium association.

More than half of the condominium owners’ votes are also required to elect the association’s administrator, members and chairman of the board or members of the audit committee, as well as to approve the association’s annual budget and to make changes to the heat supply system.

According to the law, if the residents decide to separate, they can vote to form their own association. The rules and procedure will not change.

At the same time, the former association is obliged to hand over documents, property and information to the new association within one month by means of an acceptance act, which is approved by the residents’ meeting.

Unjustified refusal to draw up such a transfer act with the new association may be sanctioned in accordance with the Contravention Code. This provision of the law will become effective three months after publication, on August 21, 2026.
