The changes are aimed at further aligning Moldova’s state aid system with European Union rules. For businesses, this means clearer procedures for obtaining support and uniform requirements for its provision.
The bill provides for several changes to the mechanism for granting state aid to enterprises.
One of the key innovations will be the prior notification procedure (prenotificare), which will allow for the discussion of state aid measures in advance, before their official approval.
In certain cases, the law also provides for the possibility of so-called “tacit authorization” if the established conditions are met.
According to the government’s assessment, these changes will increase predictability for investors and improve oversight of the use of public funds.
A Unified Register of De Minimis Aid Will Be Established
Another innovation will be the creation of a Central Registry of de minimis Aid as part of the “State Aid Registry” government information system.
It will compile information on all instances of small-scale state support provided to enterprises. This will enable monitoring of compliance with the limits established by law and increase the transparency of aid distribution.
As an example of this new approach, the government cites the existing regional state aid scheme for investments in the manufacturing industry.
It provides direct financial support to enterprises implementing investment projects and is based on transparent selection criteria, as well as differentiated levels of support depending on the region.
As the authors of the initiative note, the updated rules should provide government agencies with clearer procedures for granting aid and give enterprises greater predictability when applying for state support.
