Specifically, individual complaints may be filed online through the Integrated Case Management System using a qualified electronic signature.
The electronic service of summonses and notices will be possible in all civil cases, not just urgent ones. At the same time, the parties and their representatives will be required to notify the court of any changes to their email addresses.
Courts, in turn, will be able to automatically retrieve information from government databases and information systems via the interaction platform. The email addresses of parties to the proceedings will be retrieved directly from public registries and updated periodically.
The electronic format will also be extended to administrative cases and cases involving minor offenses. Documents and complaints may be filed electronically, and certain administrative disputes may be heard via videoconference.
The changes were initiated by the Ministry of Justice and developed taking into account proposals from the Superior Council of the Magistracy, the Agency for Digitalization in the Justice Sector, and representatives of the courts.
The new rules will take effect three months after their publication in the Monitorul Oficial.
In addition, Parliament approved, in its second reading, the Republic of Moldova’s accession to the Hague Convention on the Recognition and Enforcement of Foreign Judgments in Civil and Commercial Matters. The new mechanism will help reduce costs and shorten the time required to resolve cross-border disputes, as well as increase legal certainty for citizens and companies. For Moldova, the Convention will enter into force one year after the deposit of the instrument of accession.
