MP Doina German proposed these enforcement measures as an amendment to the bill on new measures to protect children’s rights. The suspension of these rights will be ordered by a court at the request of a bailiff if the debtor has been in arrears for at least three consecutive months. The measure will be temporary and apply for up to six months, with the possibility of extension if the debt remains outstanding.
The law provides for clear exceptions. The right to drive a vehicle will not be suspended if the vehicle is necessary for the debtor to carry out professional activities, to transport a person with disabilities, or if the debtor themselves has musculoskeletal disorders.
In addition, the bill, which passed its second reading, grants the court the authority to establish a schedule for parent-child visits, with an emphasis on assessing the risk of violence and requiring that the minor’s opinion be taken into account.
To curb the practice of “tactical payments” by unscrupulous parents, a mandatory security deposit is introduced to guarantee the continuity of child support payments, and a provision is established stating that the right to support belongs to the child, not the parent.
At the same time, administrative sanctions not involving monetary fines — such as community service or administrative detention for evading child support payments — are being introduced in cases where fines have proven ineffective.
The bill is expected to be adopted in its third reading as well.
