State Fee Cuts Procurement Complaints, but Contract Value Rises

The effect of the state duty: the number of complaints in procurement is falling, while the cost is rising

In 2025, the public and sector procurement market has a tendency to decrease the total number of disputes while increasing their aggregate value. These indicators are reflected in the report on the activity of the National Dispute Resolution Agency for 2025. The document was presented during the plenary session of the Parliament by the Chairperson Angela Munteanu.

“In the ranking of the most frequently contested procurement objects, based on their estimated value, the leading position is occupied by medical equipment. It is followed by construction works, which are also steadily included in the list of the most disputed procurement categories,” Angela Munteanu emphasized.

According to the presented statistics, during 2025, 1,206 appeals were registered, which indicates a moderate decrease in the activity of appeals compared to the indicators of 2024. The vast majority of claims – over 92% – relate directly to public procurement procedures. During the reporting period, the agency issued 1,128 decisions, with the average duration of consideration of one complaint amounting to 18 working days.

The negative dynamics of the number of complaints is explained by the introduction of the state duty. The statistics of the reporting year is given as an example: before the introduction of this financial obligation, 737 complaints were filed, while after the norm came into force – only 469. This instrument was introduced in order to minimize the practice of filing unjustified or malicious appeals by market participants.

Despite the quantitative decline, the total value of disputed procedures exceeded 8.8 billion lei, which is 2 billion lei higher than in 2024.

The ANSC report notes: “This dynamic confirms that the appeal mechanism is activated mainly in procedures with significant financial weight, where economic operators seek to protect their interests related to large public and sector procurement contracts.”

Following the examination of the submitted report, the Commission for Economy, Budget and Finance formulated a package of specialized recommendations. The parliament approved a draft resolution, which, in particular, refers to the need to digitalize administrative and management processes. The document also points to the importance of increasing transparency, strengthening institutional responsibility and introducing internal mechanisms to verify the quality of decisions.

It should be noted that in 2025, the National Agency for Dispute Resolution completed the process of institutional reorganization, as a result of which the agency was transformed into the National Dispute Resolution Body.
