All state enterprises will be reorganized

All Moldovan state enterprises in the future should switch to new organizational-legal forms corresponding to the modern economic realities, Logos Press reports.

All state enterprises will be reorganized

This was stated by MP Radu Marian at a meeting of the parliamentary commission on economy, budget and finance.

The reason for the discussion was an amendment to the draft law on amending the Law on management and denationalization of public property. The document provides for the reorganization of the state-owned Moldelectrica into a joint-stock company with 100% state capital. The authorities emphasize that this is not about privatization of a strategic object, but about bringing the management system in line with European standards.

According to the representatives of the Ministry of Energy, the transformation of Moldelectrica into a joint stock company is necessary to meet the requirements of the Independent System Operator (ISO) model, to finalize the anbandling process and to further integrate into the European energy market. In particular, Moldelectrica already has an observer status in ENTSO-E and plans to become a full member of this European network of transmission system operators.

The ministry notes that the new form of management will allow increasing operational efficiency, strengthening the country’s energy security, attracting investments, as well as strengthening control in areas such as financial reporting, internal and external audit and management responsibility.

At the same time, it is proposed to transfer the authority to manage state property in the energy sector from the Public Property Agency to the Ministry of Energy. According to the authorities, this will ensure a clearer separation of functions and increase the efficiency of the sector’s management.

The initiative was criticized by the opposition. PSRM MP Petru Burduja said that such changes should not be adopted in a hurry and through amendments to other bills.

“Why are you in such a hurry with this draft – right before the New Year? This project should be separate. This is a strategic facility that you want to transform into a joint stock company, and in the end it is not clear – will it be a closed or open type company? I understand investments, I understand ISO standards, but I don’t understand – what is the problem if it is a state enterprise? The state has always supported this enterprise, and it is a strategic object. Or do you want to privatize it too, like Giurgiulesti port?”, Burduja asked.

In response, Ion Andronicus, head of the Electricity Department of the Energy Ministry, said that the reorganization of state-owned enterprises was envisaged by the 2017 law and recommended by the Court of Accounts in 2024.

“The reorganization of the respective state-owned enterprises should have taken place much earlier. Let me remind you of the provisions of Law No. 246 of 2017, whose final and transitional provisions provided for changes concerning all state-owned enterprises to be reorganized. …The Ministry of Energy developed a plan that was coordinated with all authorities, and all of them indicated that the first step should be to change the law and introduce the authority to allow the Ministry to own a stake in joint stock companies.”

As an example, he cited the Ministry of Infrastructure and Regional Development, for which such competence is already provided in the part related to road management.

Andronik also specified that all Moldelectrica assets remain public property of the state and are not subject to alienation.
