This is provided for by the amendments approved by the Government to its previous regulations, adopted to ensure a more effective and transparent management of these procedures. Thus, the approved amendments exclude the practice of placing children and families with children under state guardianship or in preventive institutions, which is considered a form of deprivation of liberty and contrary to the best interests of the child, in full compliance with the UN Convention on the Rights of the Child and the jurisprudence of the ECtHR.
At the same time, a clear procedure is introduced for preventive placement of foreigners in a Temporary Accommodation Center on the basis of an order of the competent authority until the execution of expulsion, readmission or return measures, or until detention. The procedure for recognizing foreigners as undesirable persons is also adjusted in order to increase transparency and legal certainty by clearly stating the reasons for decisions and eliminating exceptions that no longer correspond to the current regulatory framework.
The new regulations also clarify the authority of the Center for Temporary Accommodation of Foreigners to reflect its legal and operational mandate. It also introduces the obligation to collect fingerprint data of persons placed in the Center or deported under escort within no more than 24 hours using modern live-scanner-type technology with integration of this data into the information system “State Dactiloscopic Register”. This measure will make it possible to accurately identify each person, reduce the risk of using forged documents and contribute to a more reliable settlement of cases of illegal stay.
