According to the Ministry of Economy, the current law has many contradictions with the Civil Code and other legislation, including provisions that do not comply with EU standards.
The law was adopted back in 1992: not only is it obsolete, but it has also acquired numerous provisions and sections. Such as the concept of fiscal monopoly or provisions on sanctions and other legal provisions of a secondary nature. Their place is in specialized legislation.
Also in the process of harmonization of the national legislation with the EU norms, the need to harmonize all existing definitions and regulatory rules that have emerged over time was identified.
Therefore, the new document will be a framework and will structure all stages, types and organizational forms of entrepreneurship.
It will more clearly describe the current forms of entrepreneurship without creating a legal entity, such as independent activity (self-employment) and professional activity (lawyers, doctors, notaries). As well as the procedure for starting entrepreneurial activity and interaction with state agencies – registration, obtaining permits. A separate chapter of the draft law will be devoted to this.
One of the innovations in the law is the possibility for young people aged 16 to 18 to carry out entrepreneurial activities by establishing training enterprises in the form of limited liability companies.
The greatest discussions were caused by such innovations of recent years as women’s and social entrepreneurship, measures to support and encourage social enterprises. According to experts, they should be prescribed in specialized legislative acts. There is still no consensus on the existence of a patent.
It is proposed to put the law into effect 2 years after its official publication.
