These changes to the procedure for the protection of intellectual property and amendments relating to the customs clearance of goods are proposed for inclusion in the Customs Code of the Republic of Moldova. The Ministry of Finance has submitted them to the government for approval. The amendments are driven by the harmonisation of national legislation with the EU Customs Code and related regulations.
For instance, they allow a taxpayer’s customs liabilities for a given month to be consolidated where a guarantee is in place, and also provide for the online administration of guarantees. Deferral of payment and other concessions are also permitted.
Furthermore, it is proposed to introduce a so-called self-assessment mechanism, under which a business entity may be authorised to independently carry out certain customs formalities, calculate payments and conduct checks under the supervision of the Customs Service.
The draft specifies the timeframes for processing applications submitted to the customs authorities, measures to strengthen customs controls, and sets out the content of a standard customs declaration.
The main part of the law is due to come into force on 1 January 2027. At the same time, a number of digital mechanisms will only come into effect once the information systems have been launched and their interoperability ensured.
