
Specifically, based on the results of its audit, the CNPF determined that, for 973 loan agreements, the total cost of the loan—including interest, commissions, fees, penalties, late-payment interest, and any other payments, exceeded the amount disbursed under the agreement, which violates the provisions of Law No. 202/2013 on Consumer Credit Agreements.
In order to remedy the identified violations and protect consumer interests, the CNPF ordered the lender to refund to consumers, within 180 days, the amounts exceeding the amount disbursed, specifying any obligations that may be incurred before the disbursed loan limit is reached.
At the same time, the lender was advised to review the contractual provisions and mechanisms for calculating the cost of loans so that the total cost of the loan does not exceed the amount disbursed under the agreement, including in the event of late fulfillment of contractual obligations.
In this context, consumers who entered into loan agreements with OCN “EASY CREDIT” SRL between January 1, 2024, and May 11, 2026, may consult the CNPF website for a list of agreements in which violations of legal provisions were identified.
The legal consequences set forth by law apply to these agreements, under which the lender is entitled to demand only the repayment of the original amount disbursed, excluding interest, fees, taxes, penalties, or other payments provided for in the agreement.
Consumers experiencing difficulties in exercising their rights under these provisions are strongly encouraged to contact the CNPF, the competent authority for the protection of financial services consumers.
