Residents will have to negotiate: threshold for voting in associations raised

The election of an administrator of a condominium association will require the support of more than half of the total number of unit owners. The same majority is required to appoint the chairman and members of the board, as well as the audit committee.

The relevant provisions are stipulated by the draft law, which the parliament adopted in the second reading by the votes of 65 MPs. The document significantly toughens the rules for both the establishment and management of owners’ associations.

According to the amendments, the creation of an association uniting several condominiums will require at least half of the owners’ signatures. In the case of a single building, at least a quarter. Previously, the legislation allowed the creation of an association on the basis of only five signatures.

Also, the new regulations authorize owners in associations with multiple buildings to form separate associations for their condominium. Such associations will operate under the same conditions.

As previously wrote Logos Press, the deputies cite the need to prevent the practice of creating so-called “mega-associations” that unite dozens of disparate houses that do not have a common infrastructure and are actually managed without sufficient consent of all residents. In general, the law is designed to strengthen the role of residents in deciding on the form of management of their house or group of houses.

The law will enter into force after its publication in the Official Monitor.
