Roadside Landowners to Face New Obligations for Access Roads

New obligations will be imposed on owners of roadside properties

Owners of roadside properties will be required to demolish or rebuild the access road within one month, at their own expense if necessary.

This obligation arises for them in the event of the modernization of a public highway following receipt of a notice from the highway administrator.

After the specified period expires, the administrator will have the right to demolish structures erected without a permit or in violation of the conditions set forth therein. In such cases, the costs of demolition will be borne by the landowner.

This requirement is included in a draft bill developed by the Ministry of Infrastructure and Regional Development.

The changes are related to increasingly frequent weather anomalies and the need to protect road infrastructure from damage.

It is also proposed to clarify certain concepts, as well as to regulate issues concerning roadside areas, clarify the rights and obligations of road administrators, and introduce a mechanism for temporary restrictions in the event of meteorological warnings, among other measures.

In addition, residents of settlements through which public roads pass will be required to maintain in proper condition the driveways to their yards, green spaces, and sidewalks located in front of their residential buildings and land plots.

Local authorities will oversee compliance with these obligations. They will have the right to issue orders regarding compliance and, if necessary, impose sanctions provided for by law.
