A standard mark-up on medicines is to be introduced in Moldova

In Moldova, it is proposed to establish the principle of a uniform mark-up on medicines throughout the country, regardless of where they are sold.

A corresponding provision concerning pricing policy is contained in the draft Law on Pharmaceutical Activities, drawn up by the Ministry of Health. Consultations on the draft will continue until 21 September.

The new law will replace a similar piece of legislation that has been in force in Moldova since 1993. It regulates the procedure for obtaining authorisation and carrying out activities in this sector, the requirements for the online sale of medicines and, in general, the rules governing the supervision of this market. A number of new provisions are also being introduced.

In particular, pharmacies will be prohibited from setting and applying discounts and other financial incentives that encourage the excessive purchase of medicines. At the same time, online logistics platforms and courier services will be permitted to deliver medicines to patients. However, they will be required to comply with requirements regarding the safety and traceability of medicines, as well as the protection of personal data. Delivery charges must not depend on the name of the medicines, the order value or the number of packs purchased.

According to the draft, carrying out such activities will require a permanent, non-transferable licence from the Agency for Medicines and Medical Devices, as well as a certificate of compliance with Good Pharmacy Practice (GPP).

Existing authorisations will need to be reissued free of charge within one year of the law coming into force.
