Moldova to Update Copyright Rules for Industrial Design

Copyright regulations in design are being updated

Moldova's Ministry of Justice has released a draft of a new law for public consultation, which is intended to replace the current 2007 “Law on the Protection of Industrial Designs” and bring Moldovan regulations into line with EU legislation.

Among the proposed changes, it is worth noting the expansion of the types of works that can be protected by copyright law. In addition to tangible works, such as logos and graphic symbols, the law will now include user graphical interfaces. Furthermore, industrial designs or models will be able to include motion, transitions, and other types of animation.

Digital design elements are being introduced

The methods for presenting a design when registering a product are also being expanded. Along with drawings and photographs, it will be possible to use videos, computer visualizations, and simulations.

The bill also establishes rules for the digital reproduction of designs. The rights holder will be able to prohibit others from creating, downloading, copying, and distributing files or programs that can be used to manufacture a product with such a design.

However, the design of a component will not be protected if its appearance depends on the appearance of the product itself and the component is used solely to repair or restore the product to its original appearance.

The registration procedure will change. Specifically, it is proposed that applications be examined within one month. After that, AGEPI will have two months to verify whether there are grounds for refusal. An industrial design accepted for registration will be published in the BOPI (Official Bulletin of Intellectual Property). Following publication, third parties will have two months to challenge the decision on the application.

Most provisions of the new law are expected to take effect on December 9, 2027.
