The Ministry of Labor Proposes to Bring Workers’ Rights in Line with European Standards

The rights of part-time workers and the non-discriminatory nature of those rights with respect to compensation and other labor rights, as well as the employer’s obligation to inform them about the use of fixed-term employment, will be enshrined in law.

This measure is included in a bill drafted by the Ministry of Labor and Social Protection to remove restrictions that hinder the full implementation of European occupational safety and health standards.

The bill also stipulates an obligation to inform employees and conduct consultations in the event of a company reorganization, a change in ownership structure, or a change in ownership, regardless of who makes such a decision.

In this context, the ministry is also proposing provisions to prevent mass layoffs and implement accompanying social measures, including assistance with employment or vocational retraining for laid-off workers.

The draft assigns a special role to the State Labor Inspectorate’s procedures for monitoring employers’ compliance with the aforementioned obligations.

It also provides for the imposition of sanctions for an employer’s failure to fulfill the obligation to inform an employee about working conditions in the form, scope, and within the timeframes prescribed by the Labor Code.

At the same time, a package of amendments to labor legislation has been prepared by the Ministry of Economic Development and Digitalization. As a reminder, it includes a number of measures to reduce excessive regulation in the private sector and streamline the permitting system, which, in a sense, contradict the proposals put forward by the Ministry of Labor.
