
As noted in the plenary session of the legislature, the new law is intended to provide more autonomy and transparency in the functioning of the highest body of judicial jurisdiction.
The law was amended in line with the recommendations of the Venice Commission and introduces important changes to the operation of the CC, primarily concerning the regime of incompatibility and mechanisms of accountability of constitutional judges.
In addition, the range of entities entitled to notify the Constitutional Court has been expanded, including judicial panels of the SCJ, appellate chambers and courts. Provision is made for the establishment of mandatory control of the constitutionality of international treaties, as well as the introduction of a system of disciplinary sanctions. There is also a requirement for future judges to renounce membership in a political party before taking the oath of office.
The law also regulates the mechanism of filling a vacant position of a judge depending on the reason for termination of office: resignation, death, expiration of term or termination of office.
