Moldova to join European rules to fight cybercrime

Moldovan law enforcement authorities will be able to quickly request electronic evidence directly from foreign IT companies and instantly exchange data with colleagues from other countries.

The Republic of Moldova initiates the ratification procedure of the Second Additional Protocol to the Council of Europe Convention on Cybercrime. This measure is included in the National Accession Plan for 2025-2029 and the Roadmap for the Rule of Law.

The main objective of the treaty is to increase the efficiency of cooperation between states to obtain electronic evidence needed in criminal investigations. Given the fluid nature of digital data, traditional mutual legal assistance procedures are often insufficiently expeditious. The Protocol introduces modern mechanisms, such as direct interaction with electronic communication service providers in the territory of other States, the provision of emergency assistance through 24-hour contact points and the establishment of joint investigative teams, which greatly facilitates the solving of complex cybercrime cases.

Ratification of the instrument implies not only a commitment to cooperate in good faith with other participating States, but also the implementation of strict safeguards to protect human rights, in particular the right to privacy and personal data. In this context, the national legal framework will be adapted to ensure strict judicial control over all data requests, respecting the principles of legality, necessity and proportionality.

The document will be presented by the head of the Interior Ministry at the government meeting on Wednesday, June 11.
