
The Facts of the Case
Searches were conducted on December 7 and 8, 2016, in the commune of Ungheni. The Border Police and the DIICOT Prosecutor’s Office detained 21 suspects, seized 15 cell phones, two plastic oars, a night-vision device, and nearly 3,000 packs of undeclared Moldovan cigarettes, according to reporteris.ro.
Interceptions, technical surveillance, and three arrests in the act on the banks of the Prut River revealed that the network had illegally imported 45,549 packs of cigarettes from the Republic of Moldova, causing damage to the state budget amounting to 545,880 Romanian lei (more than 2 million Moldovan lei). The Court of Appeals recalculated the civil claim upon appeal, excluding VAT and customs duties from the liabilities of the “minor” defendants and retaining only excise taxes. This means that the total amount claimed by the Customs Service was reduced compared to the merits of the claim.
The facts themselves—namely, a total of ten smuggling operations carried out between May and December 2016—were clearly limited in time and documented through real-time interception. The statute of limitations is calculated from the date the facts occurred, regardless of whether the case is with the prosecutor’s office or in court.
The Oddities of This Case
One cannot help but note the oddities of this criminal case.
Initially, hearings were rescheduled 54 times to new dates, and after 19 months of delays, a date for the trial on the merits was finally set in 2020. However, even after that, the hearings were postponed 11 more times, and the trial did not begin until 2022.
In 2023, the panel of judges was replaced, and the 22-volume case was effectively reconsidered from scratch. In 2024, the tribunal changed the classification of the alleged offense, and on June 26, 2026, the appeals chamber dismissed the case, ruling that the statute of limitations had expired on the charge of forming an organized criminal group and sentencing nine people to symbolic prison terms ranging from 3 to 6 years for smuggling.
