Moldova to Strengthen Protection for Whistleblowers Reporting Violations

The Moldovan government has approved a bill that expands protections for whistleblowers reporting violations, establishes clearer rules for submitting reports, and introduces additional requirements for internal reporting channels in public and private organizations.

The bill was drafted by the Ministry of Justice and approved by the government on July 1, 2026. The document provides for enhanced confidentiality for whistleblowers, protection against potential retaliation, and clearer regulation of the procedure for reporting violations.

Justice Minister Vladislav Kozhukhar stated: “For citizens, this bill means safety when they decide to report a violation. For institutions and the business community, it introduces clearer rules, accountability, and effective internal mechanisms.”

What Changes Are in Store for Businesses

The bill expands the obligation to establish internal channels for reporting violations. Such mechanisms will be required by: all government agencies; private companies with at least 50 employees; and certain small organizations operating in high-risk sectors.

The list of such sectors includes, in particular, financial services, anti-money laundering, transportation, and environmental protection.

For private companies with 50 to 249 employees, the bill allows for the use of shared or joint reporting channels, provided that confidentiality is maintained.

Whistleblowers will receive additional protection

The document stipulates that the whistleblower’s personal data and any information that could lead to their identification may not be disclosed, except in cases expressly provided for by law.

This guarantee will apply regardless of whether the report was submitted through an official internal channel or by other means.

In addition to the whistleblowers themselves, protection will also extend to individuals who assist them, people with professional or personal ties to them, family members, and related legal entities.

The bill expands the powers of the People’s Advocate of Moldova in monitoring the implementation of whistleblower protection measures. To carry out these new functions, the Ombudsman’s office staff will be increased by three positions.

In addition, Moldova’s National Anti-Corruption Center will be required to publish annual statistics on external reports of violations.

Whistleblowers and other protected individuals will be able to receive information, consultations, and, if necessary, state-guaranteed legal assistance.

The initiative is part of the process of aligning Moldova’s legislation with European standards in the areas of the rule of law and whistleblower protection.

The new regulations are intended to bring the national system closer to the approaches of the European Union, where mechanisms for protecting whistleblowers are viewed as one of the tools for increasing transparency in public and private organizations.
