ANRE approved the first penalties for “expired” permits

For the first time since the legislation was amended, fines have been issued for failure to use permits to connect power plants with an installed capacity of more than 200 kW to the electricity grid that were issued or extended until March 27, 2025, but not used by the expiration date, Logos Press reported.

The decision was adopted by the Board of Directors of the National Energy Regulatory Agency (ANRE), in accordance with the provisions of Law No. 164/2025 on Electricity and the legal framework regarding financial guarantees for the proper execution of connection authorizations.

According to these provisions, holders of connection permits that have not voluntarily relinquished them by June 30, 2025 and have not benefited from the projects within the stipulated timeframe, will pay a fee of 50-70% of the amount of the financial guarantee of proper execution upon the expiration of the permits.

The total amount set for the first application of the fee for non-utilization is more than 103 million lei. The funds will be transferred to the state budget. Control over payment and, if necessary, application of enforcement measures will be carried out by the State Tax Service.

According to ANRE, this measure is aimed at stimulating the efficient implementation of electricity generation projects and preventing the blocking of grid capacities due to the non-use of connection permits.
