Arguing with customs will become easier for businesses

Arguing with customs will become easier for businesses

This is provided for in the new Regulation on the Organization and Functioning of the Dispute Resolution Board within the Customs Service. It was approved by order of the Director of the agency and published on September 18, 2025.

According to the new regulations, the council consists of 12 members. From the Customs Service, it will include the chairman of the council (the head of the Customs Service) and five heads of departments of the agency or their substitutes. The other six will be representatives of business associations related to customs. They will be selected in accordance with the procedure established by the government.

The Council examines preliminary applications submitted by persons subject to audit and case files, identifies improper practices in the area of state control, makes decisions on the applications and keeps records of the decisions made.

The document emphasizes that a preliminary application is filed by a person subject to control by the CU only if he/she considers himself/herself to be infringed in his/her right due to a decision taken within the framework of the post-customs audit procedure. In other words, the scope of appealing against CU decisions is narrowed, in accordance with the provisions of the Customs Code.

The amounts subject to protest remain the same in the regulations. The applications are considered by the Council if the person subject to control has recorded in it the consent to disclose data and appeals against the decision, which establishes a customs debt of over 500 thousand lei – for legal entities, and over 250 thousand lei – for individuals. The application can be submitted within 30 days from the date of notification of the customs decision.
