Lacoste Wins Temporary EU Ban on Selected Shein Products

Lacoste vs. Shein

A French court has issued a temporary injunction against the online retailer Shein, prohibiting it from selling products in European Union countries that feature an image that may infringe on Lacoste’s well-known crocodile trademark.

According to the Boursorama website, citing AFP, a Paris court of general jurisdiction has issued preliminary injunctions pending the hearing on the merits of the case. The restrictions apply to clothing, jewelry, and fashion accessories listed on the Shein platform. The court cited a “probable infringement based on imitation” and the risk of confusion for consumers.

In addition to the temporary ban on the sale of the disputed products, the court ordered Shein to pay Lacoste interim compensation of 110,000 euros toward potential damages. Furthermore, the company must post information about the court ruling on the homepage of its website and in its mobile apps for a period of one month.

The ruling was issued by a specialized intellectual property chamber. During the preliminary proceedings, the court has the right to order provisional measures if there is a risk of further infringement before a final decision is rendered.

Shein France stated that it will issue an official comment regarding the court’s decision.

The proceedings are taking place amid increasing pressure from French authorities on the fast-fashion sector. On the same day, the government presented a draft regulation providing for the introduction of financial penalties for companies operating in this sector. According to the document, by 2030, fines for certain categories of goods could reach 20 euros per item, but would not exceed half of the item’s pre-tax price.

The measures will affect a wide range of clothing and accessories, including underwear, socks, shirts, jeans, dresses, jackets, and other items sold through international platforms such as Shein, Temu, and AliExpress.

France has been consistently tightening regulations on the fast fashion industry, citing the environmental consequences of mass production and consumption of clothing. In late June, the country’s parliament finally approved a bill aimed at limiting the growth of this market segment. Earlier, the Parisian department store BHV announced that it was ending its partnership with Shein.
