Opinion: Amendments proposed to the Electoral Code contradict the Law on the Special Legal Status of Gagauzia

This opinion was expressed during the discussion of amendments to the Electoral Code of the Republic of Moldova by Gheorghe Leichu, deputy chairman of the People's Assembly of Gagauzia. The first consultations on the package of amendments proposed to the Electoral Code were held on April 15, 2026. The discussion was organized by the CEC of Moldova.

“We do not agree that the developers have prepared amendments that contradict the Law on the special legal status of Gagauzia and the competences of the autonomy to organize elections,” he says. – These proposals go beyond the law both in terms of requirements for candidates for the position of bashkan and in giving the right to the central electoral body to supervise, control and essentially manage the CEC of Gagauzia”.

The competences of the autonomy to organize elections are violated

He considers as a contradiction the proposal that allows the CEC of Moldova, in case the People’s Assembly does not approve the composition of the electoral body of Gagauzia within ten days, regardless of the reasons, to form it independently.

It is assumed that if the People’s Assembly does not nominate its candidates, the CEC of Moldova will thus unblock the situation. And if a member of the electoral body of Gagauzia drops out, it has the right to complete it.

“According to the law, this is the right of Gagauzia, and it should be handled by the People’s Assembly,” emphasizes Gheorghiu Leichu. – All this goes beyond the law and cannot be accepted in Gagauzia.

But we agree with the developers that the legislation should be improved and the contradictions and shortcomings in the current Electoral Code of Moldova should be eliminated.

Therefore, we agreed with our colleagues from the CEC of Moldova to meet and discuss these proposals separately.

Leichu believes that today there are no problems for holding elections in Gagauzia. According to him, the state has a whole arsenal of tools that allow it to control electoral processes within the framework of the current law.
