In the future, the equivalent of a notional unit will be able to change once every three years depending on the inflation rate and its impact on the cost of enforcement proceedings.
The relevant provisions are contained in the draft amendments to the government decision No 886/2010 “on the approval of the regulation on the procedure for determining the amount of fees for the actions of bailiffs and the costs of enforcement proceedings”, which may be approved this week. The document has been under discussion for more than a year.
The draft provides for adjusting the size of the conventional unit from 20 lei to 50 lei, taking into account the inflation rate for the period from September 2010 to January 2024, which, according to the National Bureau of Statistics, amounts to 172.83 per cent.
The adjustment will be applied gradually: from January 1, 2026 – 30 lei; from January 1, 2027 – 40 lei; from January 1, 2028 – 50 lei.
According to the legislation, fees and charges are intended to cover expenses related to enforcement proceedings.
The draft law also provides for the introduction of a new additional fee in the amount of one conventional unit for the registration of procedural actions of initiation, transfer/return, suspension and termination of enforcement actions in the Information System for Recording and Management of Enforcement Documents (SIEGDE).
The authors of the draft argue that this change correlates with the obligation to register enforcement proceedings in SIEGDE, the system that populates the State Register of Enforcement Proceedings, which will come into force from September 2023. The authorities claim that the new fee will motivate bailiffs to constantly and correctly update the information in the register and will allow in the future to create an interface for participants in enforcement proceedings that will give them access to the status of the cases they are interested in.
Recall that the conditional unit used for fines for administrative offenses was increased from 20 to 50 lei back in 2016 and has remained unchanged since then.
