The thresholds for granting investment incentives will be lowered

Investors will be able to challenge acts, actions, and omissions by public authorities that affect their rights or interests.

They will be granted the right to request information on investment legislation, tax regimes, and administrative procedures. In turn, government agencies will be required to provide them with complete, clear, and up-to-date information.

The Ministry of Economic Development and Digitalization has presented a draft of a new Investment Law. It will replace the current Law on Investment in Entrepreneurial Activity of 2004, enshrine investors’ rights and guarantees, and establish new rules for granting incentives.

The document introduces provisions regarding the strategic investment regime. In addition, it revises the thresholds for land incentives and investment agreements. Requirements for investment incentives are also defined. The agreement must clearly specify their nature, the conditions for granting and applying them, and their terms of validity.

Investments worth more than 10 million euros in sectors specified by law will be considered strategic. At the same time, the threshold for granting land incentives to such investments has been lowered from 25 million to 20 million euros, and the threshold for concluding an investment agreement with the government has been lowered from 50 million to 40 million euros.

The legal status of incentives already granted may not be changed, suspended, or revoked without justification. The changes shall apply only prospectively, subject to a transition period.
