The new rules will allow Moldovan law enforcement agencies to more quickly compare DNA test results with data from European countries. This is particularly important when investigating cross-border crimes: genetic material found at a crime scene in one country may be linked to a person or a criminal case in another country.
Once the new mechanisms are implemented, DNA test results for suspects, defendants, and convicted individuals will be automatically compared with the databases of European Union member states, provided that strict data protection requirements are followed. The changes stipulate the use only of standardized genetic markers employed in European data-sharing systems. These markers allow for the identification of an individual but do not contain information about their genetic characteristics or health status.
The bill also clarifies the procedure for collecting biological samples. It will clearly define the categories of individuals from whom material for DNA analysis may be collected, taking into account the severity of the crime committed. This will eliminate existing legal ambiguities and ensure a consistent approach to the application of the law.
In addition, the bill specifies the list of institutions authorized to collect biological samples, including law enforcement agencies, correctional facilities, and the Center for Forensic Medicine. The bill must be passed by Parliament.
