
This is suggested by the amendments to the Law on State Duty No. 213/2023. They are aimed at clarifying the procedure for its calculation in the process of filing complaints by business entities against the procedure and results of public procurement.
Based on the new provisions, the refund of state duty will be made without the need for them to submit any additional applications.
Recall that last year the Parliament approved the law, according to which business entities that file appeals during the procedure of public procurement, pay a state duty. It is set at 0.5% of the estimated cost of the procedure, but not more than 50,000 lei.
Such a simple decision was caused by the increasing number of appeals filed for reasons not related to the violation of the rights of bidders. The large number of appeals filed in public procurement cases resulted in significant delays in the implementation of contracts.
The law provides that in case of partial or full satisfaction of an appeal, the fee paid to the applicant shall be refunded.
Applicants have three days from the date of filing an appeal to pay the state fee. Otherwise, the appeal is returned without consideration.
