
This is more than 300 million lei higher than in July. Open tenders continue to hold the leading position among contested procedures.
According to ANSC, the number of disputes has decreased, but the complexity of cases has increased. In June, there were 105 registered applications and 115 decisions, in July – 83 and 104 respectively, in August – 77 complaints and 76 decisions.
The total amount of the state fee paid for complaints amounted to 1,060,363.30 lei. As a result of positive decisions of the agency, economic entities will be able to recover through the State Tax Service the paid state fee totaling 754,399.97 lei. For comparison, in July 2025, the amount refunded amounted to about 620 thousand lei.
It should be noted that the state fee is fully refunded if the agency decides in favor of the applicant. Also, the fee is refunded in cases when the complaint loses the subject matter (for example, if the customer annuls or modifies the original decision). The fee is not refunded if the complainant withdraws the complaint and the ANSC does not address the merits of the complaint.
The economic operator may challenge before the ANSC any act of the contracting authority that it considers incorrect. There are two types of situations that can be appealed: the procurement documentation and the result of the procurement procedure. Economic operators have the right to hear complaints at public meetings – this gives them the opportunity not only to be present in person, but also to make sure that the process is as fair and transparent as possible. For a long time, the National Dispute Resolution Agency has faced staff shortages and a large fluctuation of dispute resolution counselors, which affected the continuity of case processing. In 4 years, it has changed 3 general directors – dispute resolution advisors, although they are appointed by the Parliament for a term of 7 years.
