Employee’s medical examination will be paid for by the employer

The Government has revised the system for covering the costs of medical examinations of employees. The costs will be covered mainly by the employer, and in some cases from FOMS (compulsory health insurance funds).

These and other norms are contained in the Regulation on Health Surveillance of Workers Exposed to Occupational Risks and in the Sanitary Regulation on Compulsory Medical Examinations of Workers for the Prevention of Infectious Diseases. They will replace the previous ones, which only partially met the EU requirements.

The new health protection regulations are aimed at preventing work-related diseases and ensuring safe working conditions, with a special focus on the construction, agriculture and HoReCa sectors.

The employer will be obliged to pay for medical examinations upon hiring, periodic examinations, as well as examinations upon resumption of the employee’s activity. The employer will also be obliged to provide additional medical examinations at the employee’s request or on the recommendation of a specialized doctor.

Costs will also affect temporary employment agents, who will be obliged to cover the costs of medical examinations of day laborers with whom an individual employment contract has been concluded.

At the same time, the MHIF will cover the costs of medical examinations of apprentices, persons deemed unfit for work, and examinations carried out after an illness or injury sustained in the workplace.

Independent employees will have to pay for compulsory medical examinations themselves.

If the employee has paid for the medical examination upon employment and is found fit for work, the employer will be required to reimburse the full amount within one month of employment.

The results of the examinations will be entered into the Fitness for Work Card. This mechanism will make it possible to apply more appropriate measures to protect the health of employees and to adapt working conditions where necessary.
