
Semiconductor technology has changed significantly since 1999, but the regulations that should protect chip topologies have lagged behind these developments. Due to the lack of a modern regulatory framework, support measures – such as tax incentives, grants or public-private partnerships – have not developed. This also leads to an outflow of specialists and reduces interest in the development of the industry within the country.
The State Intellectual Property Agency (AGEPI) has developed a draft law on semiconductor topographies. It is aimed at harmonizing national norms with modern technological realities and European standards. The draft introduces clear procedures for filing, examination, publication and issuance of certificates, as well as effective mechanisms for interaction with applicants and the possibility of restoring rights.
In particular, it envisages digitalization of registration procedures, simplification of filing and review of applications, establishment of transparent terms of administrative procedures, as well as strengthening of mechanisms for protection of rights holders’ rights. A national register of semiconductor topologies will be created.
