
Within the framework of further normative regulation in the field of consumer protection, the Civil Code and other legal framework is supplemented with European norms introducing a distributive regime of authorization of offenses for all categories of transactions. The draft document has been submitted for approval.
In case of authorization of cross-border offences on the territory of Moldova, the European norms will be applied: the competent authorities in the field of cross-border infringements of consumer rights will impose fines of up to 4% inclusive of the annual turnover of the seller or supplier in the Republic of Moldova or in the Member States of the European Union. In the absence of information on annual turnover – in the amount from 200 thousand to 2 million euros (with the equivalent in Moldovan lei).
Other types of infringements related to the right to use and transactions with digital content, tourist services, services of credit organizations, trading activities, etc. will also be subject to sanctions.
Thus, the seller’s refusal to refund amounts within 14 days after the sale transaction in case of its termination will be sanctioned up to 200 c.u.u. Also, the draft document provides for sanctions for any failure to provide causal information before concluding a transaction in any form, which may entail infringement of the rights of the consumer of the service.
