
The decision of the Supreme Court of Justice brought the Comrat City Hall to a deadlock
However, the decision of the highest judicial body did not put an end to the long-standing dispute between the local authorities and the cooperative organization over who should manage the market. It created a new legal dilemma, notes local publication gagauzinfo.md.
At the meeting of the Municipal Council, Comrat Mayor Serghei Anastasov informed about the decision of the Supreme Court of Justice and emphasized that this has put the local authorities “between a hammer and an anvil”. On the one hand, it is necessary to fulfill the court decision. On the other hand, the law does not allow this.
“There is another decision of the Supreme Court of Justice, where we are obliged to issue a permit to “GagauzCOOP” on that land plot,” the mayor said. At the same time, the land lease agreement with “GagauzCOOP” was concluded in 2010 for a period of 3 years and expired long ago.
“The law on trade prohibits specialists to issue any authorization documents if there is no lease agreement (it expired in 2013). No one today has the right to issue public land without a lease auction. This is our land, public. We need to think what to do. We are between a hammer and anvil here,” stated Sergei Anastasov.
To solve the problem, it was decided to create a special commission that will study all legal and institutional possibilities and develop recommendations for the municipal council.
