The State Chancellery has prepared a draft decision according to which it is proposed to amend the current government decree on the planning of state control. The document was reviewed this week during a meeting of state secretaries of ministries.

The changes are intended to ensure more efficient planning of control activities based on risk analysis. For this purpose, it is proposed to revise the General Methodology, approved by a government decree in 2018, in terms of the risk criteria used by controllers and their gradation, in line with the provisions of the State Control Act.

In particular, the same control body will not be entitled to conduct a planned inspection more than once in a calendar year with respect to the same person or the same object of control. Even if the business entity owns several facilities located separately from the legal address and other facilities. The only exception may be cases when a higher frequency of inspections is required, in accordance with the sectoral methodology of control planning based on risk criteria.

If the initiative is approved as proposed, the procedure for drawing up the annual inspection plan will also change. In its preparation, the degree of risk of non-fulfillment of legal requirements detected by controllers in the activities of an enterprise will be taken into account. First of all, those where the risk indicators are maximum will be checked. The list of inspections will then be drawn up in descending order.

The project also provides for the improvement of industry-specific control planning methodologies, including revision of the risk criteria used.
