Staffing crisis in courts hinders insolvency cases

There is an acute shortage of judges in Moldovan courts, caused by mass resignations. This seriously hampers the handling of insolvency cases.

“When some leave, cases are reassigned to new judges who have to start all over again. …In addition, participants in the process often use ways of contestation, unfounded motions for postponement and challenges, which further slows down the process,” explained Ludmila Oush, inspector-judge of the Judicial Inspectorate of the Superior Council of the Judiciary of the Superior Council of Magistracy.

Earlier, the problem of the lack of judges was mentioned by the deputy of “Our Party” Alexandr Berlinschii. According to him, in the courts of first instance, the real deficit exceeds 37%, in the courts of appeal – 43%, and in the Supreme Judicial Chamber, almost half of the positions remain vacant. “The procedures of vetting and then prevetting have actually paralyzed judicial processes,” he believes.

Adrian Lebedinschi, chairman of the Commission for Control over Public Finances, PSRM deputy, advised to pay attention also to the work of administrators, who “often put sticks in the wheels in some trials”.

The professional community hopes that with the entry into force of the Law on Mediation, judges will share the burden of insolvency processes with mediators.

Downward trend: not bankruptcies, but recovery of funds

According to the data of the Court of Accounts (CoA), between 2023 and the first half of 2025, the state’s interests were represented in more than 3 thousand insolvency procedures, and budgetary claims amounting to about 9 billion lei were confirmed.

In two and a half years, more than 1.7 thousand economic agents were liquidated; the amount of debts written off to the state budget amounted to almost 2.4 billion lei.

At the same time, the amount of tax liabilities returned to the state budget within insolvency procedures decreases every year: from 49.7 million lei in 2023 to 41.7 million lei in 2024 and 21.3 million lei in the first half of 2025. According to auditors’ estimates, the level of return of tax liabilities to the state budget is equal to less than 1% of the balance of claims.
