This is stipulated by a new regulation developed by the Ministry of Finance. According to the authors of the new Regulation on the procedure for planning public procurement, it prescribes a mechanism that complies with the latest changes in Moldovan legislation on public procurement, as well as with European standards of transparency and competition.
Thus, when developing the procurement plan, the contracting authority will establish its procedure taking into account the estimated value of the contract, its subject and technical requirements. Cost estimation is based on a documented cost analysis. It should reflect the real cost of goods, services or works, correlated with market conditions and financial norms.
The tenderer will have the right to divide the contract into lots. This will condition competition as well as participation of small and medium-sized enterprises in the tender. It is proposed to plan the procurement of goods by taking into account the indicators of average market prices, the place of delivery of goods, their complexity, the purpose of the procurement and the terms of execution of contracts.
If the subject matter of the procurement consists of several components or items, they may be grouped into separate lots. Accordingly, the planning, evaluation and award of contracts will be carried out for each lot separately, with the appointment of separate winners.
It is also proposed that a new procedure will be followed when there is a change in the funding plan or grant that was not known at the time of the procurement plan. The procurement plan may be adjusted in case of exceptional situations, changes in legislation, adjustments to the budget or funding sources, the need to harmonize or correct errors in the original plan, etc.
